About MAK Property Conveyancers

MAK Property Conveyancers was formed in 2009 by its founder and Principal, Karen Kendall.

Following a career in property conveyancing and related property roles by Karen, in both Australia and the United States, it was decided upon Karen relocating to Dubai and seeing a growing property market, that conveyancing services were needed to ensure Buyers, Sellers, Developers and other interested stakeholders such as Lenders, were all well represented during property transfers and transactions.

The MAK team deals daily with Buyers, Sellers, Lenders, Developers and the various property related authorities in Dubai (such as RERA and Dubai Land Department), hence MAK has developed a close and unique understanding and relationship with the different stakeholders.

What is Conveyancing?

Conveyancing literally means;

“The branch of law concerned with the preparation of documents for the transferring of property. The action of preparing documents for the transfer of property.”

Conveyancing is a process whereby a service provider, or specialist Property Conveyancer such as MAK, coordinates and represents either the Buyers, Sellers, Lenders, Developers or other stakeholders to ensure their interests in a property transfer and transaction is properly coordinated and they protected and well represented.

What key documents are required if I am a Buyer?

A completed Buyer/Client information sheet, Original Passport, (Original Visa Original Emirates ID, if applicable) Original contract / MOU, Final offer letter from your lender if applicable, NOC’s from sub/master developer.

What key documents are required if I am a Seller?

A completed Seller/Client information sheet, Original title deed or location of title deed if it is being held by parties such as your lender, Original Passport, (Original Visa Original Emirates ID, if applicable) Original contract / MOU, NOC from sub/master developer.

Can I get a property I have purchased transferred to my name if the NEW Development is not yet registered or title has not been issued to the Master or Sub developer?

No, unfortunately the Master and or Sub developer has to be granted title first prior to them transferring it to you even if you have fully paid for your property.

Can I obtain multiple original copies of the Title Deed once the property has been transferred?

Only one (1) original title deed is available per property. Attested and certified copies can be arranged if they are required. [additional copies may incur fees]

What is an NOC?

An NOC is a “No Objection Certificate”. These are usually required from Lenders, Sub/Master Developers, Community Title Managers (Body Corporates) and various other stakeholders prior to settlement and before transfers can take effect. MAK will be able to fully explain what you require and also assist in obtaining your required NOCs.

Do I have to personally attend to NOCs or attend the final Transfer and Settlement.

No, not in all cases. In most cases MAK can attend and complete all required matters on your behalf but only if MAK has your POA (Power of Attorney). This usually occurs when someone is not in Dubai but has sold or purchased a property. MAK can assist you with this process.

What fees are required?

Transfer Fees

4% of sale value plus + max of 580 AED – payable to Dubai Land Department

Developers NOC Fees as the Master Developers policies discretion – Currently 525 AED

If buying with a mortgage, the fee is 0.25% (of the loan amount) plus 290 AED – Mortgage Registration payable to Dubai Land Department

Discharge of mortgage fees – 1,605 AED, if applicable – payable to Dubai Land Department

Discharge of mortgage fees from the Mater Developer and are at the Mater Developers discretion

Trustee Fee is 4,200 AED (Inc VAT)

NB: The above fees are all subject to items included in your specific contract / MOU. All fees stated are for your guidance only and additional fees may be payable.

Please also note the Dubai Land Department fees are paid as managers (bank) cheques or credit card and are to be made payable to Dubai Land Department.

Are Powers Of Attorney (POA) fees, just fees to MAK?

No, Powers of Attorney fees are for attendances to various government departments including the Dubai Judicial Ministry and the UAE Ministry of Foreign Affairs and related fees that they charge. Fees are also in relation to Translations that are also required and also in relation to coordination of these matters on behalf of the client.
